Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using our website wastetowilderness.co.nz and placing an order with Taramea Trust, trading as Waste to Wilderness, ("we", "us", "our").

By accessing our website and placing an order, you ("you", "your", "the customer") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or place an order.

1. Introduction

We sell community-contributed compost directly to customers through our website. Our order process is managed through an embedded Jotform, and all payments are processed securely via PayPal. Please take a look at our Privacy Policy for more information about data processing.

2. The Product

  • Our compost is a natural, biologically active product. As such, variations in texture, moisture content, and composition may occur from batch to batch.
  • The compost is sold "as is". We cannot guarantee specific results for your plants or garden, as success depends on various factors beyond our control (e.g., soil type, weather, application method, plant type).
  • While we take care to screen our compost, it is a natural product and may occasionally contain small, non-composted organic materials or other minor objects.

3. Orders and Payment

  • To place an order, you must complete the order form on our website, providing accurate and current contact and delivery information.
  • By submitting the form and completing the payment process, you are making an offer to purchase the goods. A binding contract is formed once we send you an order confirmation email.
  • All prices are listed in New Zealand Dollars (NZD) and are inclusive of Goods and Services Tax (GST), unless stated otherwise.
  • All payments are processed securely through PayPal. We do not collect, receive, or store any of your financial information (like credit or debit card numbers). Your financial transaction is subject to PayPal's own terms and conditions and privacy policy.

4. Compost Donations

  • We offer customers the opportunity to donate compost to be used in various community projects.
  • By selecting and paying for a "donation" product on our website, you acknowledge that you are making a contribution and will not receive the compost yourself.
  • All donated compost is pooled, and we, Waste to Wilderness, retain sole discretion in deciding which community projects will receive the compost.
  • We also retain sole discretion in defining what constitutes a "community project." This may include, but is not limited to, community gardens, school gardens, marae, or public space revegetation projects.
  • While we keep a record of your contribution, we do not provide individual updates or reports to donors on how their specific donation has been used. We may, from time to time, share general updates on projects we've supported via our website or social media.
  • All compost donations are final and non-refundable once payment has been completed. Please note that Waste to Wilderness is not a registered charity, and therefore, we cannot issue a tax-deductible receipt for your donation.

5. Delivery

  • We deliver to the areas specified on our website/order form. If your location is outside these areas, please contact us before placing an order.
  • Delivery timeframes provided are estimates only. We will do our best to deliver within the estimated timeframe but are not liable for any delays. We do not deliver in the rain.
  • Delivery will be made to the address you provide. You are responsible for ensuring the delivery address is correct and that there is clear and safe access for our delivery personnel.
  • Our standard delivery practice is to leave the compost in a safe and accessible location on your property if you are not home (e.g., on the driveway). By placing an order, you authorise us to do so. The goods will be left at your risk, and we are not liable for any loss, theft, or damage that occurs after the product has been delivered.

6. Cancellations, Returns, and Refunds

  • Cancellations: You may cancel your order for a full refund at any time before it has been dispatched for delivery. Please contact us at admin@wastetowilderness.co.nz to request a cancellation.
  • Returns: Due to the nature of the product, we cannot accept returns of compost once it has been delivered.
  • Issues: If you believe the product you received is incorrect or has a significant issue, you must contact us within 48 hours of delivery. Please provide your order number, a description of the issue, and photographic evidence. We will assess the issue and, at our discretion, may offer a replacement or a partial/full refund.

7. Limitation of Liability

To the fullest extent permitted by New Zealand law, our liability for any claim, loss, or damage arising from the sale of our products is limited to the purchase price of the product in question. We are not liable for any indirect or consequential loss or damage, including but not limited to loss of profit, damage to property, or harm to plants.

This clause does not limit your rights under the Consumer Guarantees Act 1993, where applicable.

8. Governing Law

These Terms and any contract to which they apply are governed by the laws of New Zealand, and the courts of New Zealand shall have exclusive jurisdiction to resolve any disputes.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. The Terms that were in place at the time you placed your order will apply to that order.
